While freedom of expression is protected by the First Amendment of the US Constitution, it is not an absolute right. There are concerns of misinformation, incitement to violence, and privacy issues. While freedom of expression must be protected, there needs to be guidelines. This blog will discuss how four sectors: private internet companies including social media platforms, government and policymaking, civil society and third-party researchers, and the media address the issues of freedom of expression.

Private Internet Companies

Private internet companies, including social media platforms, have provided users with the opportunity to communicate with other users. This has allowed users throughout the world to share ideas and access diverse perspectives. However, users are not always responsible. Users will post misinformation, disinformation, and propaganda. While private internet companies attempt to control and restrict content, there is limited motivation. Section 230 of the Communications Decency Act defines private internet companies as intermediaries rather than publishers of the content and shields them from liability for any published material. In addition, sensational posts tend to attract more attention to the social media platforms. When a post goes viral, it generates business for the internet company through potential advertising revenue. As Jack M Balkin in How to Regulate (and Not Regulate) Social Media indicated content that engages emotions such as fear or anger brings more viewers to the site.

Another issue to consider is whether the site is monitored by computer algorithms or humans. Is the monitoring fair and consistent? Is the “censorship” valid or is there a restriction of freedom of expression. By developing clear guidelines, the private internet companies can maintain trust and protect freedom of expression.

Government and Policymaking

Governments play a vital role in protecting free expression and preventing censorship by enacting laws. They can establish frameworks that hold private internet companies accountable, ensuring that freedom of expression is preserved.

Governments must be careful not to overregulate internet companies, which can cause additional censorship. As indicated in The War on Free Speech: Censorship’s Global Rise many countries, both democratic and authoritarian, around the world have restricted freedom of expression. The governments’ explanations are that it is an attempt to maintain order. Is this accurate or a restriction of freedom of expression? It is important that these restrictions be reviewed regularly to ensure that they are not a violation of international human rights standards.

Civil Society and Third-Party Researchers

Civil society organizations and independent researchers are responsible for keeping governments and private internet companies accountable. These organizations review and analyze the actions of the government and internet companies. They continuously promote policies that protect freedom of expression.

Unfortunately, these groups have limited access to all the data. There is a fine line between supported documentation and misinformation. In addition, there is limited money available for these groups to perform in-depth analysis. These groups may also be pressured by the political powers of the various countries.

If civil society organizations and independent researchers want to protect freedom of expression, they must be objective and transparent. They must avoid any echo chamber effects, where they are only reviewing information from like-minded groups. They must consider both agreeing and opposing viewpoints.

Media and the News Industry

The media and news industry help maintain credibility. They inform the public in a neutral manner. They can hold internet companies and governments accountable for censorship and violations of freedom of expression. They must remain independent.

A challenge that may arise is when the media is owned by the government or private internet companies. This will affect their objectivity, affect public perception, and limit the reporting of minority perspectives.

Many media organizations feel that they have a responsibility to report accurately. Fairness and impartiality in their content reporting becomes important if they are to maintain public trust. They can do this by ensuring that they do not provide misinformation or disinformation and are not affected by political pressures.

Conclusion

Protecting freedom of expression is very important. All areas mentioned, including private internet companies, government, civil society and third-party researchers, and the media must work together to ensure that freedom of expression remains a viable part of society throughout the world.

Freedom of expression is a fundamental right; however, it can have positive and negative effects on society.
